Welcome to Rooted Yoga! Our Terms and Conditions (“Terms”) outline the rules and regulations for the use of our website. By accessing and using our website, you accept and agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access our website.

AGREEMENT OF RELEASE AND WAIVER OF LIABILITY FORM

I am participating in a yoga class or program during which I will receive information and instruction about yoga and or health. I recognize that it will require physical and mental exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in yoga. I represent and warrant that I am physically fit and I have no medical condition which would prevent my full participation. In consideration of being permitted to participate in yoga; I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating. In further consideration of being permitted to participate in yoga, I knowingly, voluntarily and expressly waive any claim I may have against Rooted Yoga, LLC or its organizers/partners, for any injury or damages that I may sustain as a result of participating. I, my heirs or legal representatives, forever release, waive, discharge and covenant negligence or other acts. I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.

UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS, AND AGREE FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Confidentiality  

The information disclosed by the Participant  is generally confidential and will not be released to any third party without written authorization from the Participant, except where required or permitted by law. Exceptions to confidentiality, include, but are not limited to, reporting child, elder, and dependent adult abuse, when a Participant makes a serious threat of violence towards a reasonably identifiable victim, or when a  Participant is dangerous to him/herself or the person or property of another.  

Fee and Fee Arrangements  

Participants are expected to pay for services at the time services are rendered. Rooted Yoga accepts all major credit cards, checks, Venmo, and cash (exact change only). There is a $25 returned check fee. 

Cancellation Policy  

Participants are responsible for payment of $25 for any missed session(s) without 24-hour notice. Participant is responsible for payment for any session(s) for which Participant failed to give Rooted Yoga at least 24-hour notice of cancellation. Cancellation notice should be left on Rooted Yoga’s voicemail at 509-315-8862.  If there are more than 1 late cancellation or “no show, Rooted Yoga may decline to schedule again or allow a regular spot on the schedule.  

Privacy Policy

Rooted Yoga LLC has created this Privacy Policy to demonstrate our firm commitment to your privacy. We highly value the trust and confidence our customers have developed in Rooted Yoga. In short, our mission is to protect your data and will do everything we can, not to jeopardize our relationship with you.

We use your data to provide you with the best customer experience. By continuing to use our website, or to order products or services from us, you agree to the terms set forth in this Privacy Policy. To illustrate our intent, the following discloses our information collection, utilization, and protection practices.

The type of information we collect

As part of administering our site, our servers log IP address and corresponding information (such as operating system, browser version, etc.) which allows us to monitor the amount of traffic to our server as well as the accessibility of our site to our customers.

Third party service providers (like CE21, Google, Facebook, etc.), may provide information about you when you link, connect, or login to your account with the third-party provider. The information varies and is controlled by that service provider or as authorized by you via your privacy settings at that service provider.

Placement of an order or registration will add you and your contact information automatically, such as name and address, phone number and email address. We will use this information to make any necessary clarifications to your order/registration, to confirm receipt of payment, and to inform you of any significant changes in product or services. You may also receive further communication regarding comparable products and upcoming workshops and/or communications from relevant third parties. 

How we use your information

We may use and process your information where you have consented for us to do so, including to contact you about relevant offers and resources from Rooted Yoga or partners when you voluntarily sign up to receive any of our products or services.

Where we have supplied you with any product or service, we may use your information to contact you if there are any changes to those products or services, such as a date time change. It is in your best interest for us to use your information in this way to continue to provide you a positive customer experience.

We may use and process your information where it is necessary for us to pursue our legitimate interests as a business, or that of a third party, for the following purposes: for analysis with our marketing strategy, to correspond or communicate with you, for prevention of fraud and other criminal activities, to comply with government requirements and requests, to comply with a request from you in connection with the exercise of your rights, to improve service to customers, to manage requests to our customer service help desk emails, for the establishment and defense of our legal rights, and to enhance and personalize your customer experience.

We do not sell e-mail addresses, phone numbers, or sell the names and physical addresses from our system to any agency of an appropriate and/or  related purpose. 

We may disclose your information to our third party service providers, agents, subcontractors and other organizations for the purposes of providing services to us or directly to you on our behalf. Such third parties may include logistics or delivery companies, cloud service providers (such as hosting and email management), marketing agencies, and administrative services.

When we use third party service providers, we only disclose to them any information that is necessary for them to provide their service and we have a contract in place that requires them to keep your information secure and not to use it other than in accordance with our specific instructions.

We may obtain certain non-precise location information about you based on information we obtain from your IP address, or with your consent, your mobile device. We may use this information to improve and customize the services we offer, for example event listings or relevant offers. We use IP addresses to analyze trends, track access and aggregate broad demographic and search information.

Information Protection

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

If at any time you wish to update or remove certain information you have provided to us or you wish to be removed entirely from our system, please contact us and specify the appropriate changes. 

You may change or correct your account information at any time by logging into your account and changing the settings, or by contacting our Customer Service department. Depending on your country of origin, you may have additional rights with respect to your information you provided to us, such as the right to obtain a copy of your information you provided to us and the right to have your information deleted, except for information we are legally required to retain. You have the choice to withdraw your consent in how we use and store your personal information at any time.
